1. We the People DID create the federation of our States. Acting through our authorized agents, “We the [actual] People of the United States…do ordain & establish this Constitution for the U.S. of A.” 1st paragraph, U.S. Constitution (The word “preamble” appears nowhere in the original.) Think of a real estate agent authorized to act on your behalf- but within limits, and who is answerable to you.
Our “Free and Independent States” were so declared “in the Name, and by the Authority of the good People of these [former] Colonies,…” – not by direct popular vote – but by “We, the Representatives of the united States of America, in General Congress Assembled..”, agents of the People. The States sent delegates to the 1st & 2nd Continental Congress, acting as agents of the People of each of those Colonies tuned States.
Justice Douglas, in Colten vs. Commonwealth of Ky. wrote, “The constitutional principle is that We the People are the sovereigns [kings & queens], the state & federal officials only our agents.”
Amendment I protects “the Right of the People peaceably to assemble, and to petition the Government for a redress of grievances.” This means people can go directly to the FEDERAL government to have issues resolved; not just through their State. – A petition is not a piece of paper with a list of signatures, but a request made to government, presented to one or more of our agents/ trustees/ servants/ fiduciaries who volunteered to serve We the [actual] People in a position in government- State, local, or federal – elected, appointed, or hired.
Amendment X – “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, shall be reserved to the States respectively, or TO THE PEOPLE.”
2. UNalienable: The Declaration of Independence: “We hold these Truths [not opinions, nor viewpoints} to be self-evident- -that all men* are created Equal [not identical], -that they are endowed by their Creator with certain UNalienable** Rights -that among [but not limited to] these Rights are Life, Liberty, and the pursuit of Happiness.
-That to secure these Rights, governments are instituted among Men.
-That whenever any Form of government becomes destructive of these end, it is the Right of the people to alter or abolish it…”
*The words ‘men’ & ‘man’, depending on context, refer not only to adult male humans, but to all people, or an individual. Those words come from the Latin ‘manus’ for hand, not another body part.
** “UNalienable Rights” means Rights that cannot be taken from us. Commonly misquoted as “inalienable”, in the U.S. we often misunderstand the prefix “in” – but in every other English speaking country, it is understood that “inalienable rights could readily be taken away. Just as “inflammable” means something that readily catches fire & burns. In the U.S., we are so confused, that a new word was coined: “‘flammable”. Recall also that in medical practice, “inflamed” is used to describe tissue that is hot & usually swollen, a though ‘on fire’, not that it cannot become swollen & hot.
Otherwise, ‘Noncompliant’ is brilliant. Deep appreciation to the Halls, and to everyone who made ‘Noncompliant & ‘The Sheriff’. These films are blessings to our country.
